Family law is the domestic relations area of the law dealing with peoples’ families and associated issues, such as divorce, child custody, spousal support, domestic violence, and division of property. It is a difficult area of law because peoples’ emotions are running high, which requires a special objective posture by the attorney.
While people are not required to have an attorney represent them in Family Law, dealing with the legal system can be very difficult—sometimes becoming an insurmountable hurdle without an attorney.
People involved with the Family Law system often find themselves dealing with a very difficult stage of their lives, including:
- Feeling of anger, hurt, abandonment, or disappointment when separating from one’s partner.
- Not being able to visit with the children because the other parent is unwilling to share the children.
- Financial difficulties having to pay support and two households in a difficult economy.
- Domestic Violence towards the other parent or to the children.
These are all sensitive issues in the Family Law system. If people can find common ground based upon reasonableness, then an alternative to litigation is present. If people can agree, then the litigation process can be avoided partially or completely—avoiding the necessity of having the Court decide issues for them. This method is less traumatic for the parties and the children, as well as less expensive than litigation. However, if one party is unreasonable and unwilling to compromise, then it is time to have the judge make a decision with an aggressive attorney at your side.
